Lloyd C. Blankfein stond in 2009 nog op de eerste plaats, en nu op plek 100, de laatste plaats dus. Oorzaak: de reputatie van Goldman Sachs die in twaalf maanden tijd door het putje is gegaan. Was Blankfein in 2009 nog de veelgeprezen ceo van de zakenbank die het beste door crisis wist te laveren, nu staat hij vooral bekend als de baas van een bank die rijk werd door de eigen klanten voor te liegen.

(Source: Bloomberg) Goldman Sachs Group Inc. received $2.9 billion for its own account as a taxpayer bailout enabled American International Group Inc. to make good on credit-default swaps linked to mortgages, a congressionally appointed panel said. The money was included in about $3.4 billion in swap- related payments, most of which AIG made following the government’s bailout, the Financial Crisis Inquiry Commission wrote in a book outlining its findings. That was in addition to about $14 billion that Goldman Sachs collected from AIG and passed to other counterparties, according to the report. The $2.9 billion “was for proprietary trades (that is, trades made solely for Goldman’s benefit rather than on behalf of a client),” the panel wrote. The payout was “largely relating” to collateralized debt obligations known as Abacus, a series of mortgage-linked investments the firm helped create, the FCIC said, without specifying the relationship. Goldman Sachs, the most profitable firm in Wall Street history, acted as a “market intermediary” and bought protection from AIG to hedge transactions with clients, Chief Financial Officer David Viniar told reporters on a conference call in 2009. The trades at issue in the FCIC’s report were hedged, and most of the payments were used to cover offsetting bets, a person with direct knowledge of them said, declining to be identified because the transactions weren’t public. The FCIC, which set out to determine the causes of the financial crisis, released its report today in Washington, simultaneously publishing a 545-page book. Contracts Retired Michael DuVally, a spokesman for New York-based Goldman Sachs, declined to comment on the panel’s findings. Chief Executive Officer Lloyd Blankfein told a Congressional panel last year that the firm lost about $1.2 billion from residential mortgage transactions in 2007 and 2008. The $3.4 billion in AIG guarantees weren’t included in a government bailout of the New York-based insurer that retired $62.1 billion in contracts by fully reimbursing banks, including Goldman Sachs and Societe Generale SA, through Federal Reserve vehicles called Maiden Lane. AIG extinguished the additional swaps, which guaranteed Abacus CDOs, in 2009, taking writedowns of $1.5 billion to $2 billion, a person with knowledge of the matter said last April. AIG originally had about $6 billion in Goldman Sachs trades that weren’t covered by the rescue, that person said. Mark Herr, an AIG spokesman, declined to comment. Goldman Sachs agreed last year to pay $550 million to settle a Securities and Exchange Commission fraud lawsuit alleging that it misled investors by underwriting and marketing a mortgage-related security called Abacus 2007-AC1 without disclosing to clients that a hedge-fund customer, Paulson & Co., was involved in creating it and planned to bet against it. Goldman Sachs fors in de fout 28 januari 2011, 10:42 uur 'Greed is good' zei speculant Gordon Gekko in de beroemde film Wallstreet uit 1987. Maar de New Yorkse investmentbank Goldman Sachs maakt het nu toch echt bont. Hebberigheid is prima, ontegenzeggelijk vormt bezitsdrang een stimulans. Onze hele maatschappij is geënt op het verkrijgen van meer - voor een beter en comfortabele leven en om zich te kunnen onderscheiden van de bekende buurman. Als het binnen normale proporties blijft, is daar niets mis mee. Maar na medeverantwoordelijk te zijn voor alle financiële ellende van de achterliggende jaren zou enige bescheidenheid bij Goldman Sachs toch voor de hand liggen. Maar niets is minder waar. 'Business as Usual' Het is 'business as usual'. De bank gaat Facebook naar de beurs brengen. Maar eerst neemt zij zelf een fors belang in het bedrijf. Om vervolgens de beurswaarde op een bizar hoog bedrag in te schatten: van €0 naar €38 mrd in 5 jaar. Dat is honderd maal de winst. Dat is buiten alle proporties en een extreme vorm van kapitalisme. Daarbij speculeert de zakenbank ook op de hebberigheid van anderen. Haar bankiers creëren een hype en verkopen bij de introductie snel het eigen aandelenbelang tegen twee of drie keer de waarde waarvoor ze het kochten. De vraag dient zich nu aan of het ethisch aanvaardbaar is dat een partij die het recht heeft een beursintroductie te verzorgen, zelf voorafgaand aan die introductie een belang opbouwt. De bank verdient vele tientallen miljoenen aan de emissie. Dat zou genoeg moeten zijn, maar dat zien ze bij Goldman Sachs anders. Greed is good. De vrije markt Door het eigen aandelenbelang komt de geloofwaardigheid als emissiebank wel ernstig in het geding. Goldman Sachs heeft namelijk belang bij een zo hoog mogelijke uitgiftekoers. Nadat de bank met veel winst haar posities meteen na de emissie heeft verkocht, zal het haar bankiers een zorg zijn wat met de koers van het aandeel gebeurd. Dat is de vrije markt, een slechte zaak. De Amerikaanse toezichthouder Sec stak overigens terecht een stokje voor het plaatsen van aandelen bij outside investors vooruitlopend op de emissie. Voor banken zou er een verbod moeten komen om een aandelenbelang op te bouwen in een bedrijf wat zij naar de beurs brengen. Of een verbod dat banken een ingenomen positie binnen drie jaar na de emissie verkoopt, een zogenaamde lock-up. Zo'n regeling verlangt Goldman Sachs wel van de investeerders die ze nu de kans geeft mee te investeren. Maar die regel legt de bank zichzelf niet op. Wat hypocriet! Misschien iets om toch eens op de agenda te zetten van de toezichthouders. Of een initiatief vanuit de politiek? Eén World Online is toch wel voldoende. Loon naar prestatie blijft een lastig begrip bij zakenbankiers. Goldman Sachs, de belangrijkste en meest gehaaide zakenbank ter wereld, zag zijn winst afgelopen jaar met 37 procent dalen tot 7,7 miljard dollar. De omzet kalfde 13 procent af tot 39 miljard dollar. In de beloning van de hoogste baas, Lloyd Blankfein, is daar echter weinig van terug te zien. Aandelenbonus Uit documenten die Goldman Sachs bij de Amerikaanse beurstoezichthouder deponeerde, blijkt dat topman Blankfein over 2010 een beloning kreeg van 13,2 miljoen dollar, omgerekend circa 10 miljoen euro. Blankfein kreeg afgelopen jaar een basissalaris van 600 duizend dollar. Daarbovenop komen aandelenbonussen ter waarde van 12,6 miljoen dollar voor het jaar 2010, zo meldt zakenkrant The Wall Street Journal. Salaris omhoog In 2009 bedroeg de aandelenbonus van Blankfein 9 miljoen dollar, bovenop zijn basissalaris van zes ton. Dit terwijl de winst van Goldman Sachs in 2009 zes miljard dollar hoger was dan in 2010. Mocht het met de bonussen dit jaar tegenvallen, dan heeft topman Blankfein in ieder geval één troost. Goldman Sachs Puts `Possible' Legal Losses at $3.4 Billion By Christine Harper - Mar 1, 2011 9:05 PM GMT+0100 Goldman Sachs Group Inc., the fifth- biggest U.S. bank by assets, said “reasonably possible” losses from legal claims against the company may amount to as much as $3.4 billion. Goldman Sachs hasn’t set aside a “significant” amount of money against the possible losses, the New York-based bank said today in a 10-K filing with the U.S. Securities and Exchange Commission. The estimate, the first of its kind disclosed by the firm, is the “upper end” of losses in matters where the risk is “more than remote but less than likely,” the firm said. Banks are releasing possible-loss estimates after the SEC said in an October letter to corporate finance chiefs that they should disclose such losses “when there is at least a reasonable possibility” that they may be incurred, even if the risk is too low to require reserves. “They’ve got the best lawyers, they’re going to drag these claims out as far as they possibly can,” said Brad Hintz, an analyst at Sanford C. Bernstein & Co. in New York who has an “outperform” rating on Goldman Sachs’s stock. “Goldman has 3 years or 3 1/2 years to build reserves for what will ultimately be settlements.” Hintz said securities law cases have a five-year statute of limitations, so claims related to the financial crisis are likely to peak in the next year. He said cases typically take four or five years to be settled. JPMorgan, Citigroup Citigroup Inc. said last week that as much as $4 billion in additional costs from pending legal matters are “possible, but not probable.” JPMorgan Chase & Co. said yesterday that it’s “reasonably possible” that legal proceedings may cause as much as $4.5 billion in losses beyond its litigation reserves. Goldman Sachs’s estimate doesn’t include any amount for cases that are at early stages or where there are significant factual issues to be resolved or novel legal issues, according to the filing. The figure was calculated by adding up three categories of potential liability, the filing said. The firm included the amount of money damages claimed, where applicable. It also added the amount of securities sold in cases where Goldman Sachs is being sued by purchasers of a deal underwritten by the company and where it’s not being indemnified. Finally, in cases where parties are demanding that Goldman Sachs repurchase securities they acquired from the firm, the calculation is based on the difference between the price paid and the estimated value on Dec. 31. Profit Drop Goldman Sachs reported a 38 percent drop in net income to $8.35 billion in 2010 from a record $13.4 billion in 2009 as trading revenue tumbled and non-compensation expenses, driven by provisions for litigation and regulatory proceedings, increased 14 percent. The 2010 litigation and regulatory costs include $550 million to settle a fraud suit brought against the firm last year by the U.S. Securities and Exchange Commission, which accused Goldman Sachs of misleading investors in a mortgage- linked investment that was sold in 2007. Goldman Sachs said in today’s filing that it’s facing complaints in federal and state courts from plaintiffs asserting that its disclosures on mortgage-related products were improper. The company estimates that aggregate cumulative losses by the plaintiffs in active cases total about $457 million as of Dec. 31. That total doesn’t include other potential claims. The plaintiffs include the Federal Home Loan Banks of Seattle, Chicago and Indianapolis, Charles Schwab Corp., Cambridge Place Investment Management Inc., Basis Yield Alpha Fund (Master) and Landesbank Baden-Wuerttemberg, the firm said. The National Credit Union Administration also plans to pursue similar claims on behalf of some credit unions, and “a number of other entities have threatened to assert claims against the firm in connection with various mortgage-related offerings,” Goldman Sachs said in the filing. In de eerste drie maanden van dit jaar gleed de bank echter af tot de tiende plek als het gaat om transacties in de Verenigde Staten. Goldman Sachs liep megadeals mis zoals de overname van T-Mobile USA door AT&T voor 39 miljard dollar en de herstructurering van verzekeraar AIG ter waarde van 59 miljard dollar. Dat meldde de New York Times maandagavond lokale tijd op basis van bronnen rond het onderzoek. Naast documenten zouden er ook gesprekken zijn aangevraagd met vertegenwoordigers van Bank of America, Goldman Sachs en Morgan Stanley. Het onderzoek richt zich op het securitisatieproces rond hypotheekleningen. Banken knipten hun hypotheekleningen op en deze opgeknipte pakketten van leningen werden vervolgens doorverkocht, het zogenaamde securitiseren. Op welk deel van het securitisatieproces het onderzoek zich richt, is niet bekend. De openbaar aanklager, Eric Schneiderman, wilde tegen de krant niet verder op het lopende onderzoek ingaan. In andere rechtszaken hebben klagers betoogd dat banken bewust informatie over de kwaliteit van de leningen achterhielden. Het onderzoek past in een reeks onderzoeken naar foutief handelen van banken rond het instorten van de huizenmarkt. Zo trof Goldman Sachs vorig jaar juli een schikking met de Amerikaanse beurswaakhond Securities and Exchange Commission (SEC) ter waarde van 550 miljoen dollar. Goldman zou investeerders in hypotheekproducten hebben misleid. De SEC stelde dat dit de grootste boete ooit was die zij van een bedrijf op Wall Street incasseerde.

Nee, daar is ook geen sprake van. Hoe lees jij het bericht? Trouwens, GS kan niet hard genoeg aangepakt worden. Die 550 miljoen is pocket money! Daar lachen ze om. Alleen al aan bonussen wordt meer uitbetaald!!!

Dat Goldman dwars door een megacrisis heen bakken geld bleef verdienen, werd daar op waarde geschat. Dat dat niet altijd even netjes ging... tsja. Dat heeft de bank toch allang, met een schikking van een half miljard dollar, afgekocht bij de Amerikaanse markttoezichthouder? Maar de liefde is aan het bekoelen. De druk op justitie om de bank alsnog te vervolgen wordt de laatste tijd steeds groter. Daar worden beleggers zenuwachtig van. De afgelopen maand is het aandeel Goldman Sachs flink in waarde gedaald. Voorliegen Op 13 april presenteerde een commissie van de Amerikaanse Senaat na twee jaar onderzoek een rapport over de oorzaken van de financiële crisis. Goldman Sachs figureert er prominent in en krijgt er stevig van langs van senator en onderzoeksleider Carl Levin. De bank heeft zich schuldig gemaakt aan het voorliegen van cliënten door hypotheekderivaten te verkopen als veilige beleggingen, terwijl ze wist dat die juist bijzonder risicovol waren. 'One shitty deal' noemde een bankmedewerker zo'n transactie in een interne mail aan zijn chef, blij dat hij een onnozele gek had gevonden die erin trapte. De gek, een Australisch hedgefonds, ging ten onder aan die deal van $ 100 mln.
